Oracle v. Google: Judge finds structure of Java APIs not copyrightable, renders jury infringement verdict moot

Thought the Oracle v. Google litigation fireworks were over? Well, if you weren't aware, during the copyright phase of the trial, the jury found that Google had infringed the structure, sequence and organization of Oracle's Java APIs. However, at the time, Judge Alsup had yet to evaluate the validity of Oracle's API copyright claims upon which that verdict was based. Today, Alsup found that Oracle's argument didn't hold water because it would expand the breadth of copyright holder's rights too far -- in essence, it would allow owners of software code to prevent others from writing different versions to perform the same functions. This ruling renders the jury's earlier infringement verdict moot, and gives Mountain View yet another courtroom victory. Despite this latest defeat, Oracle's sure to run the case up one more rung on the legal ladder, so let the countdown to the appeal begin.

NASHVILLE, Tenn. (AP) ? County music singer Randy Travis is accusing his ex-wife of divulging confidential information about him in order to damage his reputation and career.

The accusations were made in a countersuit he filed this month against his ex-wife in a federal court in Nashville.

The court documents don't say what information Elizabeth Travis is alleged to have betrayed. The filings include a copy of an August 2011 letter sent to the ex-wife by one of the singer's lawyers demanding that she "cease and desist from discussing Mr. Travis' personal and/or business affairs with third parties."

He is also accusing his ex-wife, who had been his longtime business manager, of overbilling for reimbursement for travel and other expenses.

An attorney for Elizabeth Travis did not immediately respond to a request for comment.

The countersuit is the latest salvo in the ongoing feud between the Travises. The couple divorced in 2010 after 19 years of marriage. Elizabeth Travis had been his manager for more than three decades and continued to work with him after they divorced.

She sued him last month claiming that Randy Travis made it impossible for her to do her job and terminated her management contract without proper written notice. She claimed that her ex-husband sent several men, including an armed guard, to clean out her offices on Music Row of items and records linked to Randy Travis.

A publicist for the singer did not immediately respond to a message seeking comment.

Randy Travis says in his countersuit that his ex-wife "completely destroyed the requisite degree of trust" that should exist between an artist and his personal manager. The singer wants a court to declare that his ex-wife breached her contract and to bar her from receiving any management commissions. He is also seeking attorney fees.

Another Party Heard From on Legal Education

Via links in some comments, here's an addendum to my discussion last week of practical- or client-centered legal education (which, as you recall from that post, didn't seem to get much love from the constituents on the Campos blog last week). It's a post?by Dru Stevenson at the Circuit Splits blog, which I'm afraid I wasn't aware of, titled "Should Law Schools Focus on Lawyering Skills?" Stevenson argues the answer is no. A snippet or two:

I . . . disagree with the nationwide push toward making law schools into trade schools, the attempt to make the institutions less intellectual. ?And I recently blogged?here?about the direction I would like to see schools go--echoing the vision recently outlined by the Dean of the law school at Boalt Hall (California-Berkeley). ?Comparing law to another profession, would you prefer that your surgeon had spent more time taking courses on "counseling patients," and "medical clinic management," or more time studying cellular biology and organic chemistry? For my surgery, I would prefer the one who had a more intellectually rigorous program, not one that focused on role-playing exercises and rudimentary paperwork-completing skills. ?I wonder if any other profession criticizes its theoretical wing like ours does.?

The most troubling aspect of turning the focus of law schools completely toward "skills" is that this is the seed of our institutions' destruction. When a consensus finally emerges that the whole point of law school is training kids in the mechanical tasks of lawyering - how to write a brief, how to give an opening argument, how to look up the law on something - people will then realize that law schools are not really necessary at all for teaching "skills" - these are better learned by "doing" and by repetition. A law school with a skills curriculum is a law school that is not worth the time or tuition, as the same skills would be better learned on the job in apprenticeships. ?After we all switch to teaching mechanical skills, there will be a movement to abolish law schools completely. ?The academic study of law will get absorbed back into the political science departments from whence it came, and lawyer training will be done the same way we train & license paralegals. . . . ??

In terms of marketable skills, there is an inconsistency between what the firms?say?they want and what the firms?do?when they hire new graduates. The firms say they want "practice ready" associates and complain that the law schools are too theoretical; but when given the opportunity to hire graduates from the HALF of the law schools that are mostly practice-oriented and non-theoretical, they pass over them and hire associates from the top 100 law schools instead - year after year, decade after decade. ?I know that some in the legal academy do not believe in rational markets or market discipline, so they would dismiss this as "all the firms are being stupid," or would say that the hiring partners at big firms are fooled by the prestige or brand names of elite schools. ?It's really strange, though - that after decades in practice, the graduates from the "skills" schools do not seem to rise to the top of the profession enough to influence or change the hiring patterns. ?One might expect at least?some?of the firms to realize that the "skills" schools are producing superior lawyers ("practice ready") and that some would switch to interviewing on their campuses instead of the elite schools. ?It just doesn't happen - year after year, graduates find it easier to get jobs if their diploma is from a more elite (read: more theoretical) law school. The graduates from lower-ranked law schools are much more likely to find themselves unemployed and having to start their own solo practices. The hiring market has never backed up the claims that students are better off being taught lawyering skills instead of higher thinking about the law. Law firms overall prefer to hire students from schools that tilt toward legal theory. The shift toward skills is not a response to market pressure; it runs?counter?to the market.?

Prof. Stevenson makes clear that he comes from a practically oriented school, so I appreciate hearing his perspective. I must respectfully disagree with him, however--and I say that as one who does write on the "intellectual" side and doesn't think there's anything wrong with that for individual professors. (Although being a theory type doesn't absolve one of one's fiduciary duty to ask what is best for legal education on the whole, and particularly what is best for one's own school and students.) There is no doubt that other professional wings of education do?face the same tensions and criticisms. Boalt's model is interesting, but we should no more treasure the idea of making every school more like Boalt than we should the idea of making every school more like Yale, or indeed more like any specific school.

The second paragraph excerpted above--the one that worries that "turning the focus of law schools completely toward 'skills' is . . . the seed of our institutions' destruction"-- is interesting. But I don't see why we should think of this as a bad thing in and of itself. I might (or might not) feel differently about it if every?school took this path, but if it happened in a number of places I'm not sure that Stevenson has shown why that would be so terrible.?

Finally, I agree with Stevenson that there appears to be "an inconsistency between what the firms?say?they want and what the firms?do?when they hire new graduates." But: 1) his paragraph seems heavily weighted in terms of the behavior of Biglaw firms; 2) I do believe there is a "firms are being stupid" element to this--or, put differently, I think the big firms' credentialism is (or was) partly client-driven but is also a function of foolish reproductive tendencies at those firms and hurts their business in the long run; and 3) in any event, as I argued earlier, and especially given the reality that most students don't end up at these firms regardless, it still makes sense to me to ask, not what firms want, but what clients need.?

In any event, I was happy to hear a different point of view. Read it for yourself. A couple of good comments there as well. And no, I do not think discussing this issue obscures the "it's the jobs/money" arguments, which remain important.

He's also glossing over something really important in that third paragraph: that regardless of the curriculum taught at the elite law schools, they will, on average, have smarter crops of students who are more likely to become good lawyers (see, e.g., Scalia on law clerk hiring: "The best minds are going to the best law schools. They might not learn anything while they?re there, but they don?t get any dumber."). So, all that really tells us is that firms feel the long-term potential and higher average intelligence of grads from the top schools outweighs whatever level of practice-readiness they'd have from grads of lower-ranked schools. If some of those top schools did focus on practice-readiness over theory (say, if Harvard, Columbia, UVA, and Georgetown switched to a practice-focused curriculum), we could then look at the data and have a valid basis of comparison. Without that, though, just comparing the practice-focused, low-ranked schools to the theory-focused, high-ranked schools is ignoring a staggeringly important variable.

(By the way, I don't mean to say there aren't smart students at, for instance, Alabama. Just speaking in averages and perceptions here).

Law schools need to focus on both. While a greater focus on skills-based learning is necessary. intellectualism should not be abandoned. They are both equally important to the creation of well-qualified practitioners.

I disagree with Dr Richards about the impact of these allegedly smarter students at higher tier law schools. These students might be exceptional test-takers but that doesnt meqn that on average they will be better practitionere. They will simply get better and more opportunity due to this faulty perception. I have encounterer far too many graduates from elite schools with great brains and poor common sense, which equates to inadequate lawyering skills. But alas, thus perception will likely not change...unfortunately.

I'm with Stevenson, and we do have data: Northwestern has for years been marketing itself as a "practical" elite school. Far as I know they've done fine, but no better than comparably ranked schools, like Duke, Cornell, Michigan, and UVA, in the market. Certainly there's been no market rush to Northwestern by firms to gobble up their "practice-ready" grads. Maybe this is because school can only prepare someone so much for practice.

Please permit me to offer two thoughts on this important debate.

1. Focusing on the hiring practices of the largest, most elite firms ("Biglaw") is likely not the best way to ascertain the future course of the market for law school graduates. This is the sector of the market that provided the most inefficient services to clients, and therefore experienced the most profound transformation as a consequence of the current recession. Preparing lawyers to work in Biglaw is rather like to preparing journalism students to work at print newspapers. There will always be some volume of work where the financial stakes are so high that clients will be willing to pay the kind of fees that Biglaw requires for that model to work, but the market is going to continue to push law firms for a higher ration of value received to cost charged, and firms with high fees that fund high compensation and costs will be at a serious disadvantage. Firms that hire lawyers that can more quickly provide cost-effective service to clients, in contrast, will be at an advantage. Hence, the demand for skills training emanating from both clients and legal employers.

2. Yet, even Biglaw tells us where the market is moving. Biglaw, regarding itself as the most elite market participants, naturally wants it both ways. It wants more practice-ready students since clients are no longer willing to pay for the training of young lawyers (and partners at Biglaw seem disinclined to have training costs come out of their own compensation), but Biglaw also wants smarts, since most Biglaw firms believe that the sophistication of their work demands that they hire "the best minds." Most Biglaw firms still consider a degree from an elite law school as the best proxy available for smarts. This is admittedly changing, though slowly, but it remains a prevalent view. Yet, the fact that even Biglaw wants law schools to provide more skills training, albeit at the most elite law schools from which they prefer to hire, tells us much about where the market will push legal education.

Windows XP Costs Microsoft Five Times More To Support Than Windows 7

Microsoft XP Support Costs RisingIn April 2012 Microsoft released a statement in which the tech firm told organizations that if they have not yet began migrating from Windows XP to Windows 7 they should begin immediately or soon lose support for the 13 year old operating system.

In a rather frank statement Microsoft told customers that if they had not started?the migration to a modern PC, you are late.?

Microsoft will completely abandon Windows XP in April 2014 even though 42 percent of Windows? non-home installed base continues to operating using the Windows XP system. Microsoft predicts that 11 percent of Windows users will still be running Windows XP when security patches stop in 2014.

Windows XP will finally be completely orphaned by Microsoft with no further support or patches in April 2014, nearly 13 years after it launched.

According to the report, 42 percent of Windows? non-home installed base continues remains on Windows XP. If current migration trends continue, 11 percent of all Windows users will still be running XP when the security patches stop in 2014.

In a white paper published on the?official Microsoft blog?the company points to a three-year hardware lifetime while pointing out that information technology workers? time and worker productivity costs jump by 25 and 23 percent respectively in year four. When technology reaches year five those costs increase by 29 percent for IT and 40 percent for worker costs. One of the biggest costs appears to be support time losses since workers are typically supporting users with older, slower computers compared to Windows 7 PCs.

In the meantime the new upgrade requirement will cost IT teams as they may need to create new compatible software for badge printers, industrial controllers or security hardware.

Tying the Catholic Knot: Church Teachings and Wedding Customs

Above the confusion and contentious hum that surrounds the redefining-marriage debate stands the Catholic Church. Her beliefs on marriage do not sway with public opinion, but are seated in Christ, the unchanging Truth. The Church passes on what she has received without reinterpretation.

Many people today aren?t aware of the fullness of these teachings and where they come from. As we launch into wedding season, it?s worthwhile to revisit the Church?s teachings as well as various wedding customs.

Marriage Theology

It?s the Judeo-Christian tradition from Genesis that one man marries one woman. This principle is explained in the Catechism of the Catholic Church: ?The matrimonial covenant, by which one man and a woman establish between themselves a partnership of the whole life, is by its nature ordered toward the good of the spouse and the procreation and education of offspring; this covenant between baptized persons has been raised by Christ the Lord to the dignity of a sacrament? (1601).

Catholic marriage (matrimony) is one of the seven sacraments and more than just a natural union. Since it is a spiritual bond, once validly entered into and consummated, it is permanent, unending and sealed by God (Catechism, 1640).

Fittingly, the word ?matrimony? has its origins in the Latin word mater (mother) and refers to the procreative end of marriage ? to welcome children. Catholics believe that there are two ends of marriage: procreation and unity.

God?s creative love is expressed between the married couple by children. To this end, the Church instructs married couples only to practice natural family planning within reason and forbids all use of artificial birth control (Catechism, 1652-1654). Artificial contraception interferes with the couple?s openness to God?s plan and severs the channels of grace.

Due to the seriousness and sacred quality of Catholic marriage, before the nuptials, pre-Cana (remember the wedding in the Bible where Jesus turned water into wine?) instruction is required.

Recently, the Nazareth Project for Marriage and Family Formation in the Milwaukee Archdiocese sponsored a pre-Cana retreat for engaged couples.

Father Luke Strand of Holy Family Parish in Fond du Lac, Wis., counseled couples ?to see the face of Jesus in your future spouse. The married couple must have Jesus in the center of their marriage. Married life is the prism through which we see Jesus. God is a distant reality, but not if you think of the married couple. When a person sees a married couple, they should see God.?

Another speaker, David Urbanski, encouraged couples to reflect on the idea that ?passion draws us together, but compassion holds us together.? He continued by praying: ?May you be overwhelmed by the grace of God rather than the cares of life.?

In keeping with the solemn significance of Christian marriage, many beautiful customs have developed over time. Elizabeth Olson?s website, Wedding Lore and Traditions, shares the origins of these practices.

Wedding Customs

The ring is unending, so it?s a promise of eternal love and support. In many languages, the ring is also called an ?alliance,? which reminds the newlyweds of this oath. This is why spouses exchange rings in the ceremony.

For nearly two millennia, white has been a symbol of celebration. The joy of a new life and purity are also expressed. The bride?s veil protects her modesty in church, too. It was also once thought the veil was to confuse evil spirits who might try to harm her.

In times past, the bridal party was also an effort to confuse any evil spirits that might want to upset the couple?s happiness. Now, it is more duty-focused, providing witnesses to the marriage.

In terms of groomsmen, long ago, men sometimes had to be bold. The groom would take along his strongest and most trusted family or friends to persuade the woman and her family.

We go to the Blessed Virgin Mary as children before the throne of heaven to offer her flowers as a pledge of our devotion and recognize that she will be the solace in the midst of our woe; many couples pray before images or statues of Mary while the Ave Maria or other Marian hymn is sung at the nuptial Mass.

Brides throughout the centuries have incorporated the old English rhyme ?something old, something new, something borrowed, something blue and a sixpence in her shoe? into their marriage Mass, too. This custom links her to the past, while looking forward to future happiness and fortune. In terms of the ?something blue,? blue pigment was once derived from the rare stone lapis lazuli and considered in the ancient world to be more valuable than gold. Since early Christian times, blue has been association with the Blessed Virgin Mary due to its exclusivity. It also suggests royalty and directs us to the sky ? i.e. the Queen of Heaven.

As couples prepare for weddings, may they remember what is most important: a holy marriage. Let?s hope and pray that all newlyweds will be happily Catholic ever after.

Draw People In When You Brand | Business 2 Community

The other day, I listened to the most mind-numbingly boring webinar I?ve ever heard. It was awful, which was a huge shame because a company was doing it to promote their services and enhance their brand.

When you?re reading blogs like this one, you hear about all those things you should be doing to promote your brand. Write a blog, do a webinar, etc, etc. But it?s really not enough to just do the blog or webinar ? you need to engage people and pull them in when you do so. And that?s the harder part ? as I saw so clearly in the boring product development webinar I witnessed the other day.

Here are two things you must do if you want to bring people in when you?re making a presentation about your personal brand.

Show your enthusiasm

At the end of the ?ber boring presentation, I was shocked to hear the speaker say in his dreary monotone: ?I hope that you?ve come out of here today inspired by my enthusiasm and motivated to get to work.? What?!!! Honestly, I had no idea that he was really interested in the subject. I thought he was just going through the motions because not one aspect of his voice conveyed that he was engaged.

If you?re enthusiastic about something, you need to show it. That can make all the difference in the world about getting your message across and make people want to learn more. Not sure of that approach? It works.

When I was in middle school, the high school economics professor stopped by my math class to interest the incoming 9th graders in taking his AP Microeconomics class. I?d never considered taking an economics class, much less an advanced, intense one. But Mr Rowe spoke with such enthusiasm about economics that by the end of the class, most of us has signed up for the next year. And throughout the year, he never let up. He pounded college-level economics into the brains of 9th graders with such enthusiasm and interest that we absolutely adored his class.

Enthusiasm matters. Twenty minutes after the monotone product development webinar I listen to last week, I couldn?t remember what it was about. Nearly 15 years after my 9th grade economics class, I ? a Classical Languages major in college who never took another economics class ? can still discuss supply and demand on a high level.

Tell Stories

The presentor in the webinar gave us plenty of useful information. I think. To be honest, the only part I remember is him saying ?It?s all about getting the right product at the right place at the right time.?

Why didn?t I remember anything from a webinar that was really relevant to my field? Because the entire webinar was conducted in boring generalizations. ?You should do this?? ?It?s really important to do that??

The human mind isn?t designed to remember particles of information. Instead, stories are what stick. We might not remember where or when Benjamin Franklin was born, but we?ll always remember that story about him taking a kite with a key attached out into a thunderstorm.

If you?re talking about your business or something that you personally do, you have all the stories you need. You just need to bring them out. Instead of talking in general about the right product at the right place at the right time, talk about how Steve Jobs timed the market perfectly in bringing out the iPod/iPhone/iPad. Or use an example that you worked on for your industry ? and how it came about. It?s the story that will make the difference.

Trust me, making sure you include enthusiasm and stories in whatever personal branding vehicle you choose will make a huge difference. They will draw your audience in and help them to remember you ? which is the whole point of doing those activities in the first place.

Eurovision stages battle of the oldies

BAKU, Azerbaijan (AP) ? Amid the usual jamboree of youthful exuberance ? and questionable taste ? this year's Eurovision Song Contest featured a pair of elderly acts among its most high-profile contenders.

The night opened with some two-note crooning by the UK's black-clad veteran act Engelbert Humperdinck, who Scottish comedian Robert Florence acerbically remarked on Twitter looked "like an inaccurate waxwork of Johnny Cash."

Russia's Buranovskiye Babushki, a group of six grannies, offered a similarly static stage show, but did liven up their act "Party for Everybody" with some choreographed baking in an onstage oven.

The 57-year-old pan-European competition viewed by some 125 million people worldwide is hailed by its legion of devoted fans as harmless, kitschy fun that allows Europeans to forget their differences ? and economic troubles ? for at least one night.

The winner is picked by juries and television viewers across the continent, so a broad appeal is deemed key to success.

Singing for Albania, Rona Nishliu, carefully balancing an elaborate braid, gave a frankly terrifying and ear-shattering rendition of indescribable "Suus."

Europe's more boring countries lived down to expectations with performances that were forgotten even before they were over. Slow ballads were the flavor of the evening, with Estonia arguably achieving new depths of bland.

Past the half-way mark, Romania's six-piece Mandinga mercifully livened up proceedings with a pounding musical potpourri of bagpipes and brass, extravagant wardrobe choices, and a sultry performance by lead vocalist Elena Ionescu.

Bookmakers favorite Loreen, a 28-year-old Swede of Moroccan-Berber descent, went for the windswept look as she battled a wind machine to belt out the club music-lite hit "Euphoria" and assay some vaguely robotic dance moves.

Moldova's Pasha Parfeny ended the night's two-hour proceedings with a pleasantly upbeat gypsy ditty backed up some cheery, bright-bloused beaties.

As last year's winner, oil-rich Azerbaijan is hosting the annual competition. Few think it stands any chance of a repeat victory, but the country hopes the hundreds of millions of dollars it has invested in preparing for the event will serve as a public relations coup and mitigate misgivings about its poor democracy and human rights record.

The host country, a comparatively little-known former Soviet republic, has dug deep to make sure it's also a star.

The new Crystal Hall concert venue, a light-bathed arena on a point jutting out into the Caspian Sea, cost $134 million to build and was put up in a speedy eight months. Countless more millions have been deployed embellishing the capital, Baku, and buying a huge fleet of brand new London-style taxis.

Such profligacy has aroused concerns about the spiraling costs involved in holding the contest in times of austerity.

"At the moment, if the costs are growing more and more every year and it needs to be more splendid, there are countries that would have huge difficulties, especially with financial situation in Europe at the moment, in organizing it," said Annika Nyberg Frankenhauser, media department for the European Broadcasting Union, under whose auspices Eurovision is held.

Still, on the night, the rain fell hard, although diehard Eurovision fans in Baku were not deterred and stuck it out on the windswept seafront promenade to cheer along their singer in front of the big mega-screen provided.

Amid the glitz, antigovernment activists have held a number of protests in the week running up to the final, seizing on the opportunity of the increased international media presence to draw attention to what they describe as the government's authoritarian style of rule.

On Friday, police quickly shut down a small flash mob near the competition venue, roughly dragging away dozens of demonstrators and stuffing them into waiting buses, at least of one which bore a Eurovision logo.
